Separate the tax questions behind accommodation income

Distinguish residential and tourist accommodation VAT, hotel-type services, income tax, platform deductions and records before budgeting Spanish rental income.

At a glance

  • Describe the actual services and contracting parties before deciding VAT treatment.
  • VAT exemption and income-tax obligations are separate questions.
  • Keep booking prices, platform deductions, tax and net cash distinguishable.

The VAT position of a Spanish letting depends on the actual arrangement and services, rather than simply whether the advertisement says holiday apartment. Income tax is a separate question again. Before choosing an invoice template or treating the gross booking price as spendable income, describe who supplies the accommodation, who receives the service and what is included.

This guide separates the main questions and helps prepare an adviser’s brief. It does not assess an owner’s liability or decide the treatment of a complex management structure. The property tax overview is the wider starting point, while the renting guide helps distinguish the occupation arrangements that the tax adviser needs to understand.

Start with the service being supplied

Write down the contracting parties, use, duration, services, payment route and any intermediary. Identify whether the owner supplies accommodation directly to the occupier or grants rights to another operator. Include the service descriptions in the management agreement and actual guest offer. A short, accurate factual brief is more useful than asking whether every tourist apartment has the same VAT rate.

The AEAT guidance on property-letting exemptions explains that ordinary dwelling letting is generally VAT-exempt and gives different treatment for other arrangements, including onward letting by an agency. Do not apply a residential answer automatically to a business-to-operator contract. Ask the adviser to identify the supply and recipient being assessed.

Tourist accommodation and hotel-type services

The AEAT tourist apartment VAT explanation distinguishes accommodation without hotel-type services from accommodation supplied with those services. Its guidance describes the former as exempt and the latter as subject to 10% VAT. Exemption is a particular VAT treatment; it does not mean every tax or filing question disappears.

That guidance distinguishes periodic cleaning or linen changes during a stay from cleaning and linen changes only on arrival and departure. Routine maintenance and common-area cleaning are also not automatically hotel services. Describe what is actually supplied, by whom and under which agreement; a management package’s commercial name does not settle the analysis.

Keep VAT and income-tax classification separate

The AEAT explanation of tourist letting income discusses property income and economic activity, including the significance of hotel-type services and staffing arrangements. That is a separate analysis from simply identifying a VAT exemption. Provide the adviser with the actual staff and service arrangements rather than trying to resolve both questions from a tourism registration category.

The owner’s tax residence also matters to the broader advice. Use the tax residence guide to organise that question. A UK passport, a Spanish bank account and time spent at a holiday property do not by themselves form a complete tax-residence assessment. Record the facts for each owner where the ownership is shared.

Three examples to discuss with an adviser

IllustrationFacts to confirmQuestion for the adviser
A home occupied as the tenant’s ordinary residenceParties, genuine use and included itemsWhich exemption and related obligations apply to this arrangement?
A short guest stay with turnover cleaningWho supplies each service and when cleaning occursIs the actual accommodation supply within the tourist-let exemption described by AEAT?
A serviced stay with cleaning during occupationService schedule, staffing, contract and supplierDoes the supply include hotel-type services and how should it be invoiced?

These examples organise questions; they do not establish eligibility for a particular tax result. A change in services or contracting structure can require the advice to be revisited. Record the basis of the conclusion and the point at which a new fact would trigger a review, especially if the manager is planning to expand the service after launch.

Keep the customer price and tax amount distinct

If an adviser confirms that a price includes VAT, the VAT element is not calculated by multiplying the inclusive price by the rate. For a purely mathematical example, €1,100 inclusive at 10% consists of a €1,000 net amount and €100 VAT: divide the inclusive price by 1.10 to find the net amount. This example does not establish that a particular booking is taxable at that rate.

If the quoted price is net, adding 10% would instead turn €1,000 into €1,100. State which convention the budget uses. Check cancellation charges, discounts and intermediary invoices separately rather than assuming every amount arriving in the bank belongs to the same supply or has the same treatment. Ask for the appropriate invoice and accounting method for the actual arrangement.

Do not confuse platform deductions with tax settlement

A platform payout may already exclude commission, refunds or other adjustments. Reconcile the guest price, platform statement, fees and amount received before recording income. A smaller payout does not by itself show that VAT or income tax has been paid on the owner’s behalf. Obtain the actual invoices and reports that explain each deduction.

The landlord records guide helps keep those pieces together. For a cross-border intermediary or a service invoiced by another business, ask about that service’s own VAT treatment and any relevant reporting. Do not assume that an exempt accommodation supply makes every expense invoice exempt or every input-tax amount recoverable.

Build the financial model on the confirmed basis

Use the holiday rental scenario calculator only after deciding what income and costs the fields represent. It does not calculate VAT or income tax. Avoid entering a VAT-inclusive customer price as spendable operating revenue if the relevant VAT must be accounted for separately. Equally, do not deduct a guessed VAT amount from an exempt supply simply to be cautious.

For a longer-term arrangement, the rental yield tool also gives a pre-tax illustration. Keep the tax calculation alongside it, clearly labelled and based on advice. Gross yield, operating surplus, cash flow after borrowing and money after tax are different measures. A single percentage cannot replace that sequence.

Prepare the income-tax and filing brief

Provide acquisition and ownership details, residence facts, rental periods, personal-use periods, collected amounts, fees and expense evidence. The non-resident rental income guide and resident rental income guide provide separate starting points. Confirm the applicable classification, deductions and filing obligations for the owner’s actual case and year.

Ask who will prepare returns, what documents they need and how corrections are handled. Keep a calendar based on the adviser’s confirmed obligations rather than an undated summary found online. Some obligations can exist even where the amount ultimately payable differs from the headline gross income. Do not treat a manager’s collection service as an automatic tax-filing appointment.

Review the answer when the business changes

An extra service, a new operator, a different contracting party or a change of owner can alter the facts behind the original advice. Keep the regional and municipal tourist-use checks current too. Tax registration does not provide planning permission, and tourism registration does not settle the treatment of every receipt.

Does tourist use always mean VAT must be added? No. The actual supply and services matter. Use AEAT’s distinctions and case-specific advice rather than a label alone.

Does VAT exemption remove income tax? No. The two questions need separate treatment, and related administrative obligations must be checked.

Can the calculators work out my tax bill? No. They model entered financial assumptions. Keep the professional tax calculation distinct and reconcile it with the same underlying records.

A useful adviser handover

Send the adviser a sample booking confirmation, the management agreement and an itemised list of services before launch. Label the sample clearly and remove unnecessary guest details. Ask for the conclusion to identify the facts on which it depends, the records needed and the circumstances requiring a review. Save that conclusion with the operating instructions so a later change in cleaning, staffing or the contracting party is not implemented without considering its consequences.
